Peguis Membership Second Generation and Thresholds Reform – Community Survey

Peguis First Nation is participating in a national consultation on two key issues affecting our band membership:

 • Second-Generation Cut-Off: This term refers to a person (the child) who is no longer eligible for status because:

One of their parents was a non-status individual, and one grandparent was also a non-status individual. In other words, after two consecutive generations of non-status parenting, status is no longer passed down. 

• Section 10 Voting Thresholds: 
Peguis First Nation is already recognized as a Section 10 band, meaning we have our own membership code that was approved by the Minister. However, many Peguis members have relatives in other First Nations that have not yet transitioned to Section 10 and could be affected by proposed changes to how status is legislated in Canada.

When a community decides to adopt or revise its code, it’s important to ensure that the decision has strong support. Currently, for bands who are not section 10, this requires a “double majority”—meaning the vote must be approved by: 

  1. A majority of all registered band members, and 
  1. A majority of those who actually cast a vote. 

There is a concern that the “double majority” rule may prevent some First Nations from assuming control over their membership. For example, a First Nation may have a large off-reserve population and/or may not have up-to-date contact information for all electors, making it difficult to engage with community members.
